REQUIREMENTS FOR ADVERTISEMENT

Program materials

The MSSNY AMA Credit Designation Statement must be used in any program materials, in both print and electronic formats, that reference CME credit (e.g. a course syllabus, enduring material publication, landing page of an internet activity).

Activity announcements

Activity announcements include all materials, in both print and electronic formats, that are designed to build awareness of the activity’s educational content among the target physician audience. The complete Credit Designation Statement below must always be used on any document or publication that references the number of AMA PRA Category 1 Credits™ designated for the activity.

CREDIT DESIGNATION STATEMENT

"This activity has been planned and implemented in accordance with the Essential Areas and Policies of the Medical Society of the State of New York (MSSNY) through the joint providership of Vassar Brothers CME and name of joint provider organization. Vassar Brothers CME is accredited by the MSSNY to provide continuing Medical Education for physicians.

Vassar Brothers Continuing Medical Education designates this eduring material educational activity for a maximum of #.00 AMA PRA Category 1 Credit(s)^TM. Physicians should only claim credit commensurate with the extent of their participation in the activity.

An enduring material is a certified CME activity that endures over a specified time. These include print, audio, video and Internet materials, such as monographs, podcasts, CD-ROMs, DVDs, archived webinars, as well as other web-based activities.

The enduring material must:

• Provide clear instructions to the learner on how to successfully complete the activity.

• Provide an assessment of the learner that measures achievement of the educational purpose and/or objective(s) of the activity with an established minimum performance level; examples include, but are not limited to, patient-management case studies, a post-test, and/ or application of new concepts in response to simulated problems.

• Communicate to the participants the minimum performance level that must be demonstrated in the assessment in order to successfully complete the activity for AMA PRA Category 1 Credit™.

• Provide access to appropriate bibliographic sources to allow for further study.

Designating and awarding credit for participation in an enduring material:

• Credit designation for each enduring material must be determined by a mechanism developed by the accredited CME provider to establish a good faith estimate of the amount of time a physician will take to complete the activity to achieve its purpose and/or learning objectives (e.g. the average time it takes a small sample group of the target audience to complete the material); credit is designated in 15 minute or 0.25 credit increments; accredited CME providers must round to the nearest quarter hour.

• Credit should be awarded only to physicians who meet at least the minimum performance level on the assessment as established by the accredited CME provider.

COMMERICAL INTEREST GUIDELINES

ACCME STANDARD FOR COMMERCIAL SUPPORT

A Commerical Interest is any entity producing, marketing, re-selling, or distributing health care goods or services consumed by, or used on, patients. The ACCME does not consider nonprofit or government organizations, non-health care related companies, or providers of clinical service directly to patients to be commercial interests.

Commercial support is financial, or inkind, contributions given by a commercial interest, which is used to pay all or part of the costs of a CME activity. Advertising and exhibit income is not considered commercial support.

The Short of It:

No logos (brands or company)
Discuss all brands in a drug or product class -Cannot promote one product
Disclose any vested financial interest related to the talk, and its resolution prior to the start of the event
Document the terms, conditions, and purposes of the commercial support in a written agreement

The Sunshine Act:

Any grant funding used for paying a physicians' expenses and honorarium for a continuing medical education activity does not need to be reported to CMS provided that it is "indirect payments or other transfers of value where the applicable manufacturer is 'unaware' of, that is, 'does not know,' the identity of the covered recipient during the reporting year or by the end of the second quarter of the following reporting year. CMS-1612-FC 592 When an applicable manufacturer or applicable GPO provides funding to a continuing education provider, but does not either select or pay the covered recipient speaker directly, or provide the continuing education provider with a distinct, identifiable set of covered recipients to be considered as speakers for the continuing education program, CMS will consider those payments to be excluded from reporting under §403.904(i)(1)."
